La controversia se generó en torno a las diferentes interpretaciones del factor territorial.
La Corte concluye que la autoridad que tiene la competencia para resolver la acción de tutela formulada es la de Neiva, al ser la ciudad donde se dio la vulneración de los derechos alegados por la actora.
Se ordena remitir el expediente al Juzgado Cuarto Penal Municipal con Función de Control de Garantías de Neiva para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Cuarto. Penal Municipal con Funcion de Control de Garantias de Neiva (Huila), dentro de la accion de tutela formulada por la senora Adriana Cordoba Penagos en contra de Serviactiva Soluciones Administrativas S.A.S., Inversiones Medicas S.A., Esimed S.A. y Medimas EPS.
- Segundo. REMITIR el expediente ICC- 3442, que contiene la accion de tutela presentada por la senora Adriana Cordoba Penagos, al Juzgado
- Cuarto. Penal Municipal con Funcion de Control de Garantias de Neiva (Huila), para que, de manera inmediata, tramite y adopte la decision de fondo a que haya lugar.
- Tercero. Por la Secretaria General de la Corporacion, COMUNICAR a la parte accionante y el Juzgado
